      As of March 2020, HB 1008 was signed into law and legalized industrial hemp in South Dakota.

      However, funding was initially set for $3.5 million, but due to the coronavirus, the budget may change.

      Yes, you are legally allowed to grow hemp in South Dakota. In this industrial state, hemp and CBD oil are now legal after one year of argues between the governor and legislators. In late June, the agricultural authorities approved a program that will come to action. The progress consumes a 3.5 million dollar fund to set it up.

      Federally it has been legal since 2018, but state prohibitions remained in place in South Dakota until this year.

      In 2016, an act authorizing industrial hemp for production and sale had failed in committee, and finally, in 2020, it is now legal and approved in South Dakota. It is permitted as long as it contains specific provisions. However, hemp producers must wait first for it to fully grow until approval of the state’s plan through USDA.

      Yes! In SD, you will need to obtain a license to grow it legally. Also, you will want to have a business plan in place and identify any hurdles that you may encounter, so you start off on the right path.

      South Dakota finally legalized hemp cultivation after a year spent debating details and logistics. So, hemp is now finally legal in SD as of March 2020, but it is said that coronavirus is impacting the funding. South Dakota was one of the last 3 states to still outlaw hemp.
