Yes, it is legal, and West Virginia.

You need to just fill out an official application, submit some fingerprints, take a background check, and the applicant must pay all fees associated with those tasks.

Yes, but with reinforcements between 2017 to 2018, the federal authorities just gave the promotion to use the commercial activity guidelines as trade, grow…, simultaneously going back to 2002 we realize that they had some agreement on the matter of changing the local use of the license into agronomics supplies.

The number of producers and interest in hemp crops continues to grow each year. Foresight by West Virginia Legislature establishes a licensing process that permits farmers to develop, cultivate, process, and be a broker of industrial hemp. Hemp, including products derived from it, is also legal. Now that it’s legal, the number of farmers that are interested in growing hem continues to increase according to agriculture officials.

Wow-I didn’t realize their THC threshold was so much higher than the federal .3%! How does that work? Where it’s a less stringent law than the federal? That’s something that’s always confused me with the expansion of hemp and marijuana. Like when Colorado went green, it was still illegal federally. It’s so confusing!

Yes, it is! WV was one of the first states to allow it and has one of the more relaxed regulations for THC percentage allowed (>1%, most states it is >.3%). Just like any business endeavor, you will want to have a business plan in place and identify any potential hurdles.

Way back in 2002, West Virginia passed their own Hemp Law. This gave farmers the ability to plant, grow, possess, harvest, process, and sell commercial-grade hemp. Industrial hemp is classified as an agricultural crop. Along with demand, each year, the number of producers in West Virginia increases exponentially.

Yes! The Hemp Farming Act of 2018 (commonly referred to as the Farm Bill) was passed, and the provisions therein went into effect at the end of 2018. This Act removed hemp from the Schedule 1 list of controlled substances and reinstated its presence as a regular agriculture commodity, along with products made from it. To the best of my knowledge, the specific procedures for gaining permissions to grow, though, vary based on and are dependent upon each individual state. So definitely check with the local FSA office before planting (:

Yes! The West Virginia Legislature Senate Bill 447 – Statute: W. Va. Code §§ 19-12E-1-12E-9 (2015) that recognized industrial hemp with no more than 1 % THC as an agricultural crop. The law sets up the procedures for licensing farmers so they can commercially plant, grow, harvest, possess, process, and sell hemp.

The West Virginia Legislature recently approved Senate Bill 447, recognizing industrial hemp that has no more than 1% THC as an agricultural crop. This same legislation also established licensing procedures to allow local West Virginia farmers to plant, grow, harvest, process, and sell hemp commercially.
